Original Proceeding on Petition for Writ of Habeas Corpus

MEMORANDUM OPINION

Relator, David Thomas, has filed an original petition for writ of habeas corpus. Because we have no jurisdiction to grant relief, we dismiss.

The underlying case is The State of Texas v. David Thomas, cause number 1533470-471, pending in the 351st District Court of Harris County, Texas, the Honorable George Powell presiding.

Relator seeks pretrial habeas relief in a criminal case. Under the Government Code, an appellate court has the power to issue writs in certain, limited circumstances. See TEX. GOV'T CODE § 22.221. We do not have original habeas corpus jurisdiction in criminal cases. See In re Ayers, 515 S.W.3d 356, 356-57 (Tex. App.—Houston [14th Dist.] 2016, orig. proceeding).

Accordingly, we dismiss relator's petition for lack of jurisdiction.
