Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, the Texas Department of Transportation, filed a petition for writ of mandamus complaining of the trial court's May 4, 2017 order requiring it to produce certain documents. The trial court has since set aside and vacated the challenged order. Real parties Navistar, Inc. and IC Bus, LLC filed a motion to dismiss the proceeding as moot, and they represent to this court that the relator is unopposed to the motion.

The underlying case is Melody Johnson & Estate of Mariya Johnson v. Houston Independent School District & International Truck and Engine Corp., cause number 2015-68342, pending in the 270th District Court of Harris County, Texas, the Honorable Brent Gamble presiding.

We grant the motion and dismiss the petition for writ of mandamus as moot. Any other pending motions are dismissed as moot.
