ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

It is ordered that the opinion filed herein on July 2, 2008 be modified as follows:

On page 18, delete and replace the first sentence of the first full paragraph so that the sentence reads:

“In appealing the trial court’s denial of compensation to Meiers, the trustee again contends there was no evidence any of the beneficiaries relied on the reiterated misstatement in the Consent Solicitation Statement advising the beneficiaries, that, in addition to the trustee, they had previously agreed to consider authorizing compensation for others who had worked on the case.”

All petitions for rehearing are denied. There is no change in judgment.
