On October 20, 2023, relators S.A.R.S. Trucking Ltd. and Felipe Rodriguez filed a petition for a writ of mandamus. In their mandamus petition, relators contend that the trial court abused its discretion by denying their "Motion for Leave to Late Designate Experts." Relators requested that the Court issue a writ of mandamus and "set[] aside [the trial court's] denial of [relators'] Motion for Leave to Late Designate an expert witness to address the need for and cost and effects of future lumbar spine surgery" for real party in interest, Janelle Solis, Individually and on Behalf of her Minor Children, I.C., A.S., S.G., and S.G.
On November 7, 2023, the Court requested a response to the petition for a writ of mandamus from real party in interest, due on or before November 27, 2023. On November 20, 2023, real party in interest filed a motion for extension of time to file her response to the mandamus petition. In her motion, real party in interest requests that the deadline be extended to December 27, 2023.
The motion does not include a certificate of conference but does represent that counsel for relators is unopposed to the relief requested in the motion for extension. See Tex. R. App. P. 10.1(a)(5), 10.3.
The motion of real party in interest is granted. The deadline for real party in interest, Janelle Solis, Individually and on Behalf of her Minor Children, I.C., A.S., S.G., and S.G., to file her response to relators' petition for writ of mandamus is extended to December 27, 2023.
It is so ORDERED.
