IN THE INTEREST OF: S. R., A CHILD.
Appeal from the County Court at Law No. 5 of El Paso County, Texas (TC# 2022DCM6598)
Before Alley, C.J., Palafox and Soto, JJ.
ORDER
Pursuant to Tex.R.App.P. 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.
Pending before the Court is Appellant's pro se motion dated June 21, 2024, asking for more time for an unspecified constitutional challenge as well as to correct the defects in her brief. We GRANT the motion and provide a one-week extension to July 1, 2024.
To address a constitutional challenge to a statute, the Court must first have the information requested in the attached form, which was previously provided to Appellant via an internet link.
To address the defects in Appellant's June 3, 2024 brief, which we also attach to this order, the Court previously explained that (1) it is unclear whether the brief was filed only on behalf of Alison Rodriguez or on behalf of both Alison Rodriguez and Chris Rodriguez, thus Appellant must file a signed supplemental document stating who the brief was filed for; and (2) this supplemental document must also state that both it and the brief have been delivered to the attorneys for the other parties, either in person, by mail, by commercial delivery service, by fax, or by email.
The constitutional challenge form and the supplemental document we describe must be filed in this Court on or before July 1, 2024. If the constitutional challenge form is not filed by July 1, 2024, the Court will move forward based solely on the matters asserted in the brief. If the supplemental document is not filed by July 1, 2024, the Court will move forward with the understanding that the June 3, 2024 brief was filed only for Alison Rodriguez.
The Court will allow an additional 20 days after July 1, 2024, for any party to file a response brief. After July 22, 2024, the Court will consider this appeal.
IT IS SO ORDERED this 24th day of June 2024.
