No. 14-04-00622-CV

Memorandum Opinion filed July 8, 2004.

Original Proceeding Writ of Mandamus

Petition for Writ of Mandamus Dismissed.

Panel consists of Chief Justice HEDGES and Justices FROST and GUZMAN.

MEMORANDUM OPINION

On June 28, 2004, relator filed a petition for writ of mandamus in this court. See TEX. GOV'T. CODE ANN. § 22.221 (Vernon Supp. 2004); see also TEX. R. APP. P. 52. In his petition, relator attempts to have this court compel prosecutors with the Harris County District Attorney's office who are handling his criminal prosecutions for aggravated assault and kidnapping, filed under trial court cause number 984,004 and 984,009 in the 339th District Court, to respond to his discovery requests.

This court is empowered to issue writs of mandamus against judges of district courts or county courts in our district, but we may not issue writs against other parties unless necessary to enforce our jurisdiction. TEX. GOV'T CODE ANN. § 22.221(a), (b) (Vernon Supp. 2004). Because relator does not allege that the prosecutors in the District Attorney's office are interfering with this court's jurisdiction, we lack jurisdiction over this proceeding. See In re Miller, 2003 WL 22976088, 14-03-01350-CV (Tex. App.-Houston [14th Dist.] Dec. 18, 2003, orig. proceeding) (mem. op.).

Accordingly, we dismiss relator's petition for writ of mandamus.
