IN RE RODERICK L. REESE, Relator

Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Roderick L. Reese, has filed a pro se petition for a writ of mandamus seeking to compel the respondents, four prison officials at the Wayne Scott Unit in Angleton, Texas, in Brazoria County, to have relator be "single-celled," to "be scheduled for PM law library sessions," and for "any and all prohibit[]ed discrimination, harassment, and retaliation" against him to cease. Relator also filed a "Motion to Proceed In Forma Pauperis." We dismiss the petition for want of jurisdiction and dismiss the motion as moot.

Relator's petition does not identify any underlying trial court cause number or court.

This Court's mandamus jurisdiction is limited to: (1) issuance of writs of mandamus against a district court judge or county court judge in this Court's district, and (2) issuance of writs of mandamus necessary to enforce our appellate jurisdiction. See TEX. GOV'T CODE ANN. § 22.221(a)-(b) (West 2004). Because relator's petition is directed at various prison officials, and not a district judge, and does not indicate that issuance of a writ is necessary to enforce our appellate jurisdiction, we lack jurisdiction to issue the writ. See id. at § 22.221(a), (b)(1).

Accordingly, we dismiss the petition for a writ of mandamus for want of jurisdiction. We dismiss relator's motion to proceed in forma pauperis as moot.

PER CURIAM Panel consists of Chief Justice Radack and Justices Keyes and Lloyd.
