MEMORANDUM OPINION


Relator, Rapid Settlements, Ltd., filed a petition for writ of mandamus challenging a temporary restraining order signed by respondent on May 7, 2008. Relator has filed a motion to dismiss the petition for writ of mandamus.

The respondent is The Honorable Elizabeth Ray of the 165th Judicial District Courtof Harris County. Judge Ray was sitting as ancillary judge for the Harris Countydistrict courts at the time she signed the temporary restraining order at issue. Theunderlying suit is William Prante v. Rapid Settlement, Ltd., No. 2008-26239 (11thJudicial District Court, Harris County, Tex.).

Accordingly, we dismiss the petition for writ of mandamus.
