MEMORANDUM OPINION


Relators, Lonnie Phillips Jr. and Lance Phillips, as next friend of Lonnie Phillips Jr., have filed a petition for writ of mandamus, complaining of the following orders of the trial court: (1) the October 28, 2003 order granting the summary judgment motion of real party in interest Kimberly Rae Bing Thompson and denying the summary judgment motion of relators; (2) the May 12, 2003 order granting the summary judgment motion of real party in interest Betty Willy and denying the summary judgment motion of relators, and (3) the alleged refusal to grant default judgment against real party in interest Kenneth Bing Jr.

The Honorable Ogden Bass, visiting Judge, sitting for the HonorableBen Hardin, Judge of the 23rd District Court of Brazoria County, Texas. The underlying lawsuit is Lonnie Phillips Jr. et al v. Billy Willy et al., Cause No. 11869*BH00, in the 23rd District Court of Brazoria County, Texas.

After due consideration, the Court denies the petition for writ of mandamus.
