I. INTRODUCTION
The retailer defendants in the cases listed on Exhibits A and B attached hereto have moved to be dismissed from these actions pursuant to Fed.R.Civ.P. 12(b)(6), on the basis that plaintiffs failed to state a claim against them upon which relief can be granted. Having reviewed the motions, the responses that were filed, and the replies thereto, the court hereby finds and rules as follows:
II. BACKGROUND
The Multi-district Litigation 1407 ("MDL") plaintiffs filed actions against numerous manufacturers and retailers for personal injuries allegedly related to the ingestion of over-the-counter cold and/or weight loss medicine containing phenylpropanolamine ("PPA"). Although many of these actions were originally filed in state court, some were removed to federal court based on diversity of citizenship under 28 U.S.C. § 1332 and then transferred to this court to be part of the MDL. In their removal petitions, the removing defendants argued that the non-diverse retailer defendants were fraudulently joined under state law because plaintiffs failed to state a cognizable cause of action against them. Many of the plaintiffs moved to remand the cases back to state court. With few exceptions, the court denied these motions, finding that the retailer defendants had been fraudulently joined. Based in large part on the court's prior orders denying remand, many of the retailer defendants now move the court to dismiss the claims against them, with prejudice, pursuant to Fed.R.Civ.P. 12(b)(6).
III. DISCUSSION
A. Standard for Motion to Dismiss
Federal R. Civ. P. 12(b)(6) authorizes a court to dismiss a complaint for failure to state a claim upon which relief can be granted. A complaint will be dismissed under Fed.R.Civ.P. 12(b)(6) only if it fails to present a set of facts which, if proven to be true, would entitled the plaintiff to legal redress.See Abramson v. Brownstein, 897 F.2d 389, 391 (9th Cir. 1990). In considering a motion to dismiss brought under Rule 12(b)(6), the court must accept all facts alleged in the complaint to be true, and draw all inferences from those facts in the light most favorable to the plaintiff. Id. A plaintiff cannot survive a motion to dismiss, however, on conclusory legal claims alone. See Buckey v. County of Los Angeles, 968 F.2d 791, 794 (9th Cir. 1992).
B. The Motions to Dismiss Require Case-Specific Analysis
The retailer defendants have filed group and individual motions suggesting that the court should rule on the motions en masse. However, the very nature of a motion to dismiss prevents such a global ruling. Without examining the plaintiffs' individual complaints and applying the applicable state law to the same, the court cannot determine whether each plaintiff has sufficiently pled facts, that if proven to be true, would entitled the plaintiff to legal redress.
So far, retailers have filed motions to dismiss which involve over 300 cases and the substantive law of at least three states.
As the court has stated in prior orders, making such case-specific rulings are neither the purpose, nor the forte, of a court presiding over a multi-district litigation. A MDL seeks to promote judicial economy and litigant efficiency by allowing the transferee court to preside over matters common among all cases. In re Medridia Products Liability Litigation, 2004 WL 1725430, (N.D. Ohio 2004). Given this function, the transferee court typically does not rule on cumbersome, case-specific legal issues. Id. at *5; In re Orthopedic Bone Screw Prods. Liab. Litig., 1997 WL 109595, **2-3 (E.D. Pa. 1997) (finding that adjudication of summary judgment motions pertaining to state law claims would slow down the MDL process, thereby deferring state law dispositive motions to the transferor courts). The MDL procedure is instead designed to maximize efficiency and fairness by minimizing both the sheer number of rulings required, and any discrepancies between and among them. See 28 U.S.C. § 1407; In re Plumbing Fixture Cases, 298 F. Supp. 484, 491-92 (J.P.M.L. 1968) ("The purpose of Section 1407 as shown independently by its clear language . . . makes it clear that its remedial aim is to eliminate the potential for conflicting contemporaneous pretrial rulings by coordinate [sic] district and appellate courts in multidistrict related civil actions.") Indeed, 28 U.S.C. § 1407 specifically appears to contemplate a more narrow role for an MDL transferor court; as the Ninth Circuit has noted, "there must be some pretrial motions MDL courts are not authorized to rule upon because section 1407(a) does not transfer the case for the conduct of all pretrial proceedings, only those that are `coordinated or consolidated.'" In re American Continental Corporation/Lincoln Sav. Loan Securities Litigation, 102 F.3d 1524, 1543 (9th Cir. 1996) (rev'd on other grounds sub nom.Lexecon Inc. v. Milberg Weiss Bershad Hynes Lerach, 523 U.S. 26 (1998)).
Therefore, because the motions require a case-specific analysis not appropriate for an MDL court, the retailers' motions listed on Exhibit A, with the exception of those motions listed in italics, are stricken and should be refiled with the transferor court upon remand, where appropriate. Those motions listed on Exhibit A that are in italics are also stricken, but are stricken because the motions involve actions where a stay is in effect as to either defendants Chattem, Inc., The Delaco Company or Sidmak Laboratories, Inc. k/n/a Pliva. These motions are stricken pursuant to the court's July 16, 2004 Minute Order striking motions pending in cases where a stay is in effect. Listed on Exhibit B are those retailers' motions to which plaintiffs did not object, thereby conceding that they did not state a claim against the retailer defendants. The court grants these motions.
In the following two cases, Davis v. Bayer Corporation, et al., MDL No. 03-CV-2107-BJR and Jackson v. Bayer Corporation, et al., 03-CV-2104-BJR, the plaintiffs filed motions seeking to strike the defendant retailers' motions to dismiss as untimely. The court agrees and strikes the retailers' motions in these two cases as untimely pursuant to the court's November 17, 2003 order.
IV. CONCLUSION
For the foregoing reasons, the retailer defendants' motions set forth on Exhibit A are STRICKEN. The motions listed on Exhibit B are GRANTED.
