MEMORANDUM OPINION


Relators, Jacqueline Muro, Individually, and as Next Friend of Abel Gonzalez, a minor, and Javier Gonzalez, have filed a petition for writ of mandamus challenging an order dated July 1, 2005, signed by the Honorable Kent Sullivan, denying the relators' motion to compel.

The underlying lawsuit is styled Jacqueline Muro, et. al v. Dilicia McLenan, et. al, No. 2002-53258, and, at the time the petition was filed, the suit was pending in the 80th District Court of Harris County, Texas. However, while the petition was pending, the case was transferred, and is now pending in the Probate Court No. 2 of Harris County, Texas.

We deny the petition for writ of mandamus.
