ORDER

On October 26, 2017, relator MPT of Twelve Oaks, LP filed a petition for writ of mandamus in this court. Relator asks this court to order the Honorable Linda Storey, Judge of the County Civil Court at Law No. 3, in Harris County, Texas, to set aside her order dated September 14, 2017, which: (1) denied relator MPT of Twelve Oaks, LP's motion to dismiss for lack of subject-matter jurisdiction, and (2) granted real party-in-interest Westside Surgical Hospital, LLC's motion to reduce amount of appeal bond for forcible retainer.

The action below is set for jury trial on November 29, 2017.

Our court, on its own initiative, may without notice grant any just relief pending the court's action on the petition. See Tex. R. App. P. 52.10.

It appears from the facts stated in the petition for writ of mandamus that relator's request for relief requires further consideration and that relator will be prejudiced unless immediate temporary relief staying the trial is granted. We therefore STAY the trial until a final decision by this court on relator's petition for writ of mandamus, or until further order of this court.
