Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, Catherine Murrah Molloy, filed a petition for writ of mandamus, challenging the trial court's denial of her plea to the jurisdiction concerning the standing of paternal grandparents. On August 29, 2019, this Court issued an opinion denying relief. Relator filed a motion for rehearing, which the Court overruled. Relator filed an en banc motion for reconsideration.

The underlying case is In the Matter of the Marriage of Kevin Alan Fletcher and Catherine Murrah Molloy and in the Interest of H.A.F. and C.P.F., cause number 2018-67151, pending in the 257th District Court of Harris County, Texas, the Honorable Sandra Peake presiding.

The panel, on its own motion, withdraws the opinion of August 29, 2019, and issues this opinion in its place.

The petition for writ of mandamus is denied. The en banc court, by separate order issued this date, has voted to overrule the motion for en banc reonsideration.
