[Modification of opinion (104 Cal.App.4th 247; 127 Cal.Rptr.2d 876).]

This modification requires editorial changes to headnote (2), page 248, of the advance report. In the bound volume report, headnote (2) will be deleted and subsequent headnotes renumbered. The modification also requires the movement of text affecting pages 248-255 of the bound volume report.

OPINION

THE COURT.

It is ordered that the opinion filed December 11, 2002, be modified as follows:

Opinion on page 4 [104 Cal.App.4th 251, advance report], footnote 6 is deleted, which will require renumbering subsequent footnotes.

There is no change in the judgment.
