This proceeding arises out of Cause No. 2004-CVQ-001003-D4, styled Alfredo Enrique Franco McIntosh, et al. v. American National Bank, et al., filed in the 406th Judicial District Court, Webb County, Texas. The Honorable Andres Reyes signed the order that is the subject of this proceeding.

Petition for Writ of Mandamus Denied.

MEMORANDUM OPINION


On August 19, 2004, relators filed a petition for writ of mandamus and a motion for emergency stay. This court has determined that the relators are not entitled to the relief sought. Therefore, the petition and motion are DENIED. Tex.R.App.P. 52.8(a).

Relators shall pay all costs incurred in this proceeding.
