This proceeding arises out of Cause No. 2013-CR-6698, styled State of Texas v. Michael Joseph Griffith, formerly pending in the 186th Judicial District Court, Bexar County, Texas, the Honorable Jefferson Moore presiding.

On November 20, 2017, relator Robert Martinez filed a petition for writ of mandamus, complaining of the trial court's refusal to rule on his "Motion to Compel State Court Appointed Attorney (Yolanda T. Huff) to Return Defendant's Files With Notice of Yolanda T. Huff's Repeated Made [sic] Material Misrepresentation." It appears from the record relator provided to this court that relator filed his motion on August 28, 2017 and he made inquiries on three different dates as to the status of any ruling on his motion. This court is of the opinion that a serious question concerning the mandamus relief sought requires further consideration. See TEX. R. APP. P. 52.8(b). The respondent may file a response to the petition for writ of mandamus in this court no later than December 4, 2017. Any such response must conform to Texas Rule of Appellate Procedure 52.4.

It is so ORDERED on November 22, 2017.
