MEMORANDUM OPINION


Relator, Marin Lugo, has filed a pro se petition for writ of mandamus requesting that this Court reverse the trial court's ruling that allowed his retained counsel, Edward P. Silas to withdraw. We deny the petition. Relator's petition does not meet the requirements of the Texas Rules of Appellate Procedure because it does not certify that a copy was served on respondent. See TEX. R. APP. P. 9.5, 52.3(j). Moreover, relator has been appointed counsel and is not entitled to hybrid representation. See Patrick v. State, 906 S.W. 2d 481, 498 (Tex.Crim.App. 1995); Gray v. Shipley, 877 S.W. 2d 806 (Tex.App.-Houston {1st Dist.} 1994, orig. proceeding). The petition for writ of mandamus is denied. It is so ORDERED.

The underlying proceeding, trial court cause number 1104195, is pending in the 184th District Court, Harris County.

We note that the trial court has appointed counsel Gilberto Villarreal to represent relator in trial court cause number 1104195.

The Honorable Jan Krocker, Judge, 184th District Court is named as respondent.
