On November 15, 2023, relators Leo Lapuerta, M.D., F.A.C.S., and The Plastic Surgery Institute of Southeast Texas, P.A. filed a petition for a writ of mandamus. On November 30, 2023, the Court requested a response to the petition for a writ of mandamus from real party in interest, Jose Torres, due on or before December 20, 2023. On December 12, 2023, Torres filed a motion for extension of time to file his response to the mandamus petition. The Court granted Torres's, extending the deadline for filing a response to the mandamus petition to January 19, 2024.
On January 18, 2024, Torres filed a "Second Unopposed Motion for Extension of Time to File a Response[]" to the mandamus petition. Torres seeks an additional thirty days to file his response to the mandamus petition, extending the deadline to February 19, 2024. The motion includes a certificate of conference which states that relators are unopposed to the relief requested in the motion for extension. See Tex. R. App. P. 10.1(a)(5), 10.3.
The motion of real party in interest is granted. The deadline for Torres to file his response to relators' petition for writ of mandamus is extended to February 19, 2024. Absent extraordinary circumstances, no further extensions will be granted, and the failure to file a response by February 19, 2024 may result in the original proceeding being considered by the Court without a response to the petition for writ of mandamus.
