In the Interest of K.H.G., a Child
Trial court: 310th District Court of Harris County Trial court case number: 2021 -00544
ORDER OF ABATEMENT
APRIL FARRIS JUDGE
Appellant, mother, filed a notice of appeal from the trial court's August 28, 2023 Order Terminating the Parent-Child Relationship, terminating mother's parental rights to her minor child, K.H.G. The clerk's record was filed on October 3, 2023 and the reporter's record was filed on October 6, 2023. Accordingly, the deadline for the filing of mother's brief was October 26, 2023. See Tex. R. App. P. 28.4(a)(1) ("Appeals in parental termination . . . cases . . . are governed by the rules of appellate procedure for accelerated appeals . . ."), 38.6(a) (deadline for filing brief in accelerated appeal twenty days from completion of appellate record).
On October 11, 2023, mother, through counsel, filed a "Motion to Abate Appeal." In the motion, mother states that "on October 3, 2023 and again on October 11, 2023," mother "filed requests the supplement the clerk's record." Mother therefore requests that the appeal be abated until the clerk's record is "complete."
Mother's motion includes a certificate of conference stating that appellee is not opposed to the relief requested in the motion. See Tex. R. App. P. 10.1(a)(5), 10.3(a)(2).
Mother's motion is granted. This appeal is abated, treated as a closed case, and removed from the Court's active docket. Until a party successfully moves to reinstate this appeal, the Court will take no further action other than to receive and hold any documents tendered during the period of abatement.
It is so ORDERED.
