IN RE Gary L. KENNEDY
MEMORANDUM OPINION
Original Mandamus Proceeding PER CURIAM Sitting: Karen Angelini, Justice Marialyn Barnard, Justice Luz Elena D. Chapa, Justice PETITION FOR WRIT OF MANDAMUS DENIED
This proceeding arises out of Cause No. 2015CR3877, styled State of Texas v. Gary L. Kennedy, pending in the 227th Judicial District Court, Bexar County, Texas, the Honorable Kevin M. O'Connell presiding. --------
On August 17, 2016 relator Gary L. Kennedy filed a petition for writ of mandamus in which he raised three issues: (1) ineffective assistance of counsel; (2) a failure by the State to fully disclose evidence; and (3) the trial court prevented cross examination of the State's expert witness. Mandamus relief will issue only when a relator shows: (1) he has no adequate remedy at law, and (2) he seeks to compel a ministerial act. In re State ex rel. Weeks, 391 S.W.3d 117, 122 (Tex. Crim. App. 2013). Realtor has failed to show that he has no adequate remedy on appeal. Accordingly, this court has determined that Realtor is not entitled to the relief sought. Therefore, the petition is denied. TEX. R. APP. P. 52.8(a).
