Original Proceeding on Petition for Writ of Mandamus

MEMORANDUM OPINION

Relator, David Lorenza Joyner, was charged by indictment with the offense of sexual assault in the underlying case currently pending before the trial court. Claiming that the trial court denied his motion to dismiss the indictment, Joyner filed a pro se petition for writ of mandamus requesting that this Court (1) compel the district court clerk to forward Joyner's notice of appeal and the trial court's Certification of Defendant's Right to Appeal to this Court and (2) compel the trial court to enter a Certification of Defendant's Right to Appeal. We deny the petition.

The underlying case is State of Texas v. David Lorenza Joyner, cause number 1446567, pending in the 351st District Court of Harris County, Texas, the Honorable Terrill L. Flenniken presiding.
