MEMORANDUM OPINION

Phillip Jackson seeks a writ of mandamus to compel the trial court to hold a hearing on his motion for summary judgment.

The underlying case is In the Matter of the Marriage of Phillip Jackson and Roxanne Gonzalez, cause number 88823-F, pending in the 300th District Court of Brazoria County, Texas, the Honorable Randall Hufstetler presiding.

We deny the petition.
