IN THE INTEREST OF I.F., E.F. AND F.F., CHILDREN
On Appeal from the 255th Judicial District Court Dallas County, Texas Trial Court Cause No. DF-19-21932
ORDER
BONNIE LEE GOLDSTEIN JUSTICE.
The reporter's record is overdue. We have granted Court Reporter Yolanda Atkins two requests for extension. Rather than file the reporter's record by the date established in the order granting her second request, Ms. Atkins filed a letter on October 11, 2021 stating that she has not received any correspondence regarding this case or any payment arrangements for the record. Appellant filed a letter on November 5 stating that Ms. Atkins has informed him that her fee to prepare the reporter's record is $1,750. Appellant states he is financially unable to pay the fee at this time and asks the Court for assistance. Rule 145 of the Texas Rules of Civil Procedure sets forth the procedure a party must follow to obtain a free record on appeal. See Tex. R. Civ. P. 145. On the Court's own motion we ORDER appellant to file, by November 30, 2021, written verification that he has filed a Statement of Inability to Afford Payment of Court Costs in the trial court. See id. 145(b). We caution appellant that failure to comply may result in an order that the appeal be submitted without the reporter's record. See Tex. R. App. P. 37.3(c).
Ms. Atkins's first extension request was filed before the due date for the reporter's record.
We DIRECT the Clerk of this Court to send a copy of this order to Ms. Atkins and all parties.
