ORDER MODIFYING OPINION

THE COURT:

IT IS ORDERED that the opinion filed herein on August 26, 2008, be modified in the following particulars:

On page 6, footnote 2, delete the third and fourth sentences in their entirety beginning “Although the motion was sealed,” and in their place insert the following sentence:

Although the motion was sealed, counsel for the Sheriff’s department filed an opposition and her argument before the judge revealed that she was familiar with the substance of the motion.

This modification does not constitute a change in the judgment.
