MEMORANDUM OPINION


Carl Douglas Hayes filed a petition for writ of mandamus asking this Court to order the Harris County District Clerk to file his "Tort Claim" petition.

It seems that Hayes is actively filing mandamus proceedings in multiple courts of appeals. Based upon those courts opinions, it appears that the issue was the same as is presented to us. See In re Hayes, No. 14-05-00782-CV, 2005 Tex. App. LEXIS 6407 (Tex.App.-Houston [14th Dist.] August 11, 2005, orig. proceeding); In re Hayes, No. 04-05-00501-CV, 2005 Tex. App. LEXIS 6073 (Tex.App.-San Antonio August 3, 2005, orig. proceeding); In re Hayes, No. 06-05-00094-CV, 2005 Tex. App. LEXIS 5776 (Tex.App.-Texarkana July 26, 2005, orig. proceeding); In re Hayes, No. 07-05-0262-CV, 2005 Tex. App. LEXIS 5768 (Tex.App.-Amarillo July 25, 2005, orig. proceeding); In re Hayes, No. 13-05-00454-CV, 2005 Tex. App. LEXIS 5706 (Tex.App.-Corpus Christi July 22, 2005, orig. proceeding).

For the same reasons, the petition for writ of mandamus filed with this Court is dismissed for want of jurisdiction. Id.; see also In re Perkins, No. 10-04-00308-CV, 2004 Tex. App. LEXIS 9561 (Tex.App.-Waco Oct. 27, 2004, orig. proceeding); In re Pena, No. 10-04-000050-CR, 2004 Tex. App. LEXIS 2327 (Tex.App.-Waco March 10, 2004, orig. proceeding).
