MEMORANDUM OPINION


Relator, Kadar Hamilton, has filed a petition for a writ of mandamus asking this Court to direct respondent to vacate her order of November 11, 2008 denying relator's "Motion to Dismiss Under Texas Family Code Section 152.202" and to direct respondent to dismiss the petition for modification of conservatorship filed by real party in interest, Rebecca Mincy. Relator also filed a motion for emergency stay.

The respondent is the Honorable Judy Warne of the 1 257th District Court of Harris County. The underlying suit is In the Interest of Xander Hamilton, a Minor Child, No. 2006-48490 (257th Dist. Ct., Harris County, Tex.).

We deny the petition for writ of mandamus and the motion to stay.
