MEMORANDUM OPINION

Tex.R.App.P. 47.4.


Charles Matthew Farmer, who is an inmate confined in the Correctional Institutions Division of the Texas Department of Criminal Justice, seeks mandamus relief to compel the Honorable Dennis Powell, Judge of the 163rd District Court of Orange County, Texas, and Mickey Tompkins, the court reporter for the 163rd District Court, to file a complete record of Cause No. B980336-R with this Court. Farmer complains that the court reporter filed an incomplete record in his appeal. He concedes that he has acquired a reporter's record of the testimony at issue. Farmer's conviction was affirmed on appeal and our mandate issued on October 22, 2003. See Farmer v. State, No. 09-01-371 CR (Tex.App.-Beaumont Feb. 12, 2003, pet. ref'd) (not designated for publication). A post-conviction writ of habeas corpus has also been filed and denied without written order by the Court of Criminal Appeals. See Ex parte Farmer, No. WR-59,944-02 (Tex.Crim.App. Jan. 10, 2005). The appeal is final, and the relator has not demonstrated that any act or omission of the respondents prevent him from seeking post-conviction relief. The relator has not shown that he is entitled to the relief sought.

The petition for writ of mandamus, filed February 25, 2005, is DENIED.
