After Chief Justice Burns and Justices Molberg and Reichek each determined not to voluntarily recuse themselves, the matter was certified to the entire Court. The motion was then decided by the Court sitting en banc. See TEX. R. APP. P. 16.3(b).

ORDER

ROBERT D. BURNS, III, CHIEF JUSTICE

Before the Court is relator's July 21, 2021 "Objection to the Court hearing his case and motion to transfer mandamus to Second Court of Appeals." With respect to the portion of the motion seeking to recuse Chief Justice Burns, Justice Molberg, and Justice Reichek, appellant's motion is DENIED. The portion of the motion seeking transfer to the Second Court of Appeals will be referred to the Texas Supreme Court for consideration pursuant to the procedure set forth in Miles v. Ford Motor Company, 914 S.W.2d 135, 137 n.2 (Tex. 1995) (per curiam).
