MEMORANDUM OPINION


On January 5, 2006, Ricardo Childress filed a petition for writ of mandamus seeking mandamus relief from the trial court's failure to rule on his motion for post-conviction DNA testing. On January 13, 2006, the trial court filed a copy of its letter setting Childress's motion for a hearing on February 8, 2006. Accordingly, Childress's petition for writ of mandamus is denied as moot.
