Opinion

No. 04-04-00558-CV

Delivered and Filed: August 11, 2004.

Original Mandamus Proceeding

This proceeding arises out of Cause No. 291383, styled Jose Padilla and Elyssa San Miguel Mercado v. Jesus Cadena and Ramsey Cadena. The caption on the petition in the underlying case indicates it was assigned to County Court at Law No. 10, Bexar Bexar County, Texas, in which the Honorable Irene A. Rios is the presiding judge; and the caption on the challenged order indicates it is an order of that court. But the challenged order was signed by the Honorable Karen Crouch, the presiding judge of County Court at Law No. 8, Bexar County, Texas.

Motion for Emergency Relief Denied; Petition for Writ of Mandamus Denied.

Sitting: Sarah B. DUNCAN, Justice, Sandee Bryan MARION, Justice, Phylis J. SPEEDLIN, Justice.

MEMORANDUM OPINION

The court has considered relator's petition for a writ of mandamus and motion for emergency relief, and is of the opinion that relief should be denied. See Tex.R.App.P. 52.8(a). Accordingly, relator's petition for a writ of mandamus and motion for emergency relief are denied.

Relator shall pay all costs incurred in this proceeding.

The clerk of this court is directed to transmit a copy of this opinion to the attorneys of record, the trial court judge, and the trial court clerk.
