This proceeding arises out of Cause No. 06-500, styled Kendall County v. BTEX Ranch, L.P., pending in the 216th Judicial District Court, Kendall County, Texas, the Honorable Stephen B. Ables presiding. However, the challenged ruling was made by the Honorable Michael P. Peden, presiding judge of the 285th Judicial District Court, Bexar County, Texas.

MEMORANDUM OPINION


The court has considered relator's petition for a writ of mandamus and is of the opinion that relief should be denied. See Tex. R. App. P. 52.8(a). Accordingly, relator's petition for a writ of mandamus is denied.
