This proceeding arises out of Cause No. 3096, styled State of Texas v. Lyle Richard Brummett, pending in the 216th Judicial District Court, Kerr County, Texas, the Honorable N. Keith Williams presiding.

On May 7, 2013, Relator Lyle Richard Brummett filed a petition for writ of mandamus. The court has determined that it lacks jurisdiction over Relator's petition. Accordingly, the petition for writ of mandamus is DISMISSED FOR LACK OF JURISDICTION. See TEX. R. APP. P. 52.8(a). The court's opinion will issue at a later date.

It is so ORDERED on May 15, 2013.
