Original Mandamus Proceeding.

This proceeding arises out of Cause No. 2003-CI-02445, styled In the Matter of the Marriage of Michelle Berry and Larry Allan Berry and In the Interest of Kathleen Jewell Berry, Lauren Michelle Berry, and Lawson Allan Berry, Children, pending in the 166th Judicial District Court, Bexar County, Texas. Relator's complaint appears to arise from orders signed by both the Honorable David Peeples and the Honorable Martha Tanner.

PETITION FOR WRIT OF MANDAMUS DENIED.

MEMORANDUM OPINION


On August 21, 2003, relator filed a petition for writ of mandamus. The rules of appellate procedure require that a relator provide the court with "a properly authenticated transcript of any relevant testimony from any underlying proceeding, including any exhibits offered into evidence, or a statement that no testimony was adduced in connection with the matter complained." Tex.R.App.P. 52.7(a). Relator has not provided this court with any transcripts from any of the hearings in the underlying proceeding. Without a complete record from the proceedings below, this court cannot determine whether relator is entitled to the relief which he seeks. Accordingly, we deny relator's petition for writ of mandamus without prejudice to his refiling a petition in compliance with Rule 52 of the Texas Rules of Appellate Procedure. See Tex.R.App.P. 52.8(a).
