MEMORANDUM OPINION

Relator, Wayne Ernest Barker, filed a petition for writ of mandamus requesting this Court to "compel" respondent to rule on relator's motion for default judgment, which relator states he filed on July 8, 2008.

The respondent is The Honorable Tracy Christopher of the 295th Judicial District Court of Harris County. The underlying suit is Wayne Ernest Barker v. Theresa Chang, Charles Rosenthal, Roe Meredith Wilson, Baldwin Chin, Chris Morton, and George H. Godwin, No. 2008-14490 (295th Judicial District Court, Harris County, Tex.).

We deny the petition for writ of mandamus.
