MEMORANDUM OPINION


On January 25, 2007, relator filed a petition for writ of mandamus. On January 26, 2007, the Real Party in Interest, Lone Star Ob/Gyn Associates, filed a copy of its proposed Notice of Non Suit and Order. Accordingly, as the underlying case has been nonsuited, this mandamus proceeding is now moot. Therefore, the petition is DENIED. Tex. R. App. P. 52.8(a).
