ORDER

PER CURIAM

Pursuant to Tex.R.App.P. 10.4(a), this Order may have been issued by a single Justice sitting on the panel.

A motion to withdraw as attorney of record and appoint new attorney on appeal was filed in the trial court on July 26, 2024, by Jose E. Troche, the Attorney Ad Litem for the children. The trial court's prior order of termination signed on July 9, 2024, had ordered Mr. Troche to continue serving as the children's Attorney Ad Litem as long as the children remain in the conservatorship of the Texas Department of Family and Protective Services.

Accordingly, this case is ABATED and REMANDED to the trial court for it to consider and rule on Mr. Troche's motion. See A.M. v. Tex. Dep't of Family & Protective Services, No. 03-10-00767-CV, 2011 WL 255548, at *1 (Tex. App.-Austin Jan. 25, 2011, no pet.) (abating appeal and remanding to the trial court to consider motion to withdraw and appoint new counsel in termination of parental rights case).

Due to the time-sensitive nature of an appeal from an order terminating parental rights, the trial court shall consider and rule on the pending motion on or before August 9, 2024, and the resulting order shall promptly be filed with the district clerk the same day. The district clerk is ordered to promptly file with this Court a supplemental clerk's record to include the trial court's order.

The initial clerk's record and reporter's record in this appeal remain due on August 5, 2024.

IT IS SO ORDERED this 30th day of July 2024.
