WILBURN ELBERT HORNER, JR., Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 5th District Court Cass County, Texas
Trial Court No. 2019F00145 Before Morriss, C.J., Burgess and Stevens, JJ.
MEMORANDUM OPINION

Wilburn Elbert Horner, Jr., was convicted of indecency with a child by exposure, which is the subject of this appeal, and of indecency with a child by sexual contact, which is the subject of his appeal in our cause number 06-20-00067-CR. On appeal, Horner filed a single, consolidated brief in which he argued that the trial court (1) violated his Sixth and Fourteenth Amendment rights by excluding relevant evidence and (2) abused its discretion in allowing outcry testimony. We have addressed each of these issues in our opinion issued in cause number 06-20-00067-CR, styled Wilburn Elbert Horner, Jr. v. The State of Texas.

For the reasons stated in that opinion, we likewise affirm the trial court's judgment in this case.
