Hoffman v. State

District Court of Appeal of Florida, Third District
Oct 10, 2001
796 So. 2d 1214 (Fla. Dist. Ct. App. 2001)

Opinion

Case No. 3D00-3527

Opinion filed October 10, 2001.

An appeal from the Circuit Court for Dade County, Jerald Bagley, Judge. Lower Tribunal No. 00-14393.

Bennett H. Brummer, Public Defender, and Maria E. Lauredo and Robert Godfrey, Assistant Public Defenders, for appellant.

Robert A. Butterworth, Attorney General, and Linda S. Katz, Assistant Attorney General, for appellee.

Before COPE and GERSTEN, JJ., and NESBITT, Senior Judge.

Although the trial court conducted a Nelson inquiry, it is not clear that the trial court ever squarely confronted the question whether appellant had received effective assistance of counsel, and the record indicates that the appellant did not. We reverse the convictions and remand for a new trial.

Nelson v. State, 274 So.2d 256 (Fla. 2d DCA 1973).

Reversed and remanded.
