Hartford v. Tucker

Appellate Court of Connecticut
Dec 24, 1985
501 A.2d 398 (Conn. App. Ct. 1985)

Opinion

(3285)

Argued November 11, 1985

Decision released December 24, 1985

Actions to foreclose tax liens on certain property owned by the named defendant, brought to the Superior Court in the judicial district of Hartford-New Britain at Hartford, where the court, Satter, J., granted the named defendant's motions to implead the properties' rent receivers and their sureties as third party defendants; thereafter, the court, N. O'Neill, J., granted the third party defendants motions to dismiss the third party complaints against them and the named defendant appealed to this court. No error.

Stanley V. Tucker, pro se, the appellant (named defendant).

Frederick D. Augenstern, for the appellees (third party defendants Frances Gionfriddo et al.).

Michael G. Durham, for the appellee (third party defendant Western Surety Co.).

James F. Kane, for the appellees (third party defendants Frank Smith et al.).

Larry P. Levesque, for the appellee (plaintiff).

The named defendant has appealed the dismissal of his third party complaints against the receivers of rents and their respective sureties as a result of the defendant's failure to obtain the requisite prior permission of the court.

There are four cases involved in this appeal which present the same issues: Hartford Superior Court docket numbers 287787, 287788, 287789 and 287790.

We carefully reviewed the named defendant's claims in these matters and find them to be without merit. See Tucker v. American Ins. Co., 3 Conn. App. 397, 399, 488 A.2d 1278 (1985).
