Appeal from the 34th District Court of El Paso County, Texas (TC# 20030D00505-34-1) MEMORANDUM OPINION

This is an attempted appeal from an order denying Justin Grant Hall's motion for DNA testing. See TEX.CODE CRIM.PROC.ANN. arts. 64.01-64.05 (West 2006 & Supp. 2016). The clerk's docketing certificate reflects that Appellant was convicted of capital murder and sentenced to death. Under Article 64.05, the Court of Criminal Appeals has jurisdiction of this direct appeal from the order denying Appellant's motion for DNA testing. TEX.CODE CRIM.PROC.ANN. art. 64.05. The appeal is dismissed for lack for jurisdiction. April 26, 2017

Appellant's attorney notified the Court that the notice of appeal was inadvertently filed in this Court by the El Paso County District Clerk, but it has been forwarded to the Court of Criminal Appeals.
