Gold v. Gold

District Court of Appeal of Florida, Third District
Aug 30, 1982
417 So. 2d 1076 (Fla. Dist. Ct. App. 1982)

Opinion

No. 81-2124.

August 3, 1982. Rehearing Denied August 30, 1982.

Appeal from Circuit Court, Dade County; Ellen Morphonios Gable, Judge.

Horton, Perse Ginsberg and Mallory H. Horton, Miami, for appellant.

Fine, Jacobson, Block, Klein, Colan Simon and Irwin J. Block and Linda Ann Wells, Miami, for appellee.

Before BARKDULL, DANIEL S. PEARSON and FERGUSON, JJ.

The final judgment and the corrected final judgment are, as the wife concedes, in error in the single respect that the award of permanent periodic alimony made therein fails to provide for termination of this alimony award upon the death of the husband. See Plant v. Plant, 320 So.2d 455 (Fla. 3d DCA 1975). The judgments are modified to so provide and in all other respects affirmed.

Affirmed as modified.
