Note from the reporter of decisions: The writing of January 5, 2001, is styled " After Remand from the Alabama Supreme Court," but it appears to be the Court of Criminal Appeals' response to the Supreme Court's order of May 26, 2000, issuing a writ of mandamus in Ex Parte Sullivan, 779 So.2d 1157 (Ala. 2000). (The October 6, 1999, opinion of the Court of Criminal Appeals is published at 748 So.2d 914.)


Pursuant to the Supreme Court's opinion in Ex parte Sullivan, 779 So.2d 1157 (Ala. 2000), this Court's judgment entered on October 6, 1999, is hereby set aside.

JUDGMENT OF OCTOBER 6, 1999, SET ASIDE.
