MEMORANDUM OPINION


By letter dated September 6, 2005, this Court notified appellant that the time for filing his brief had expired. The Court directed appellant to file, within ten days, both an appellant's brief and an extension motion that complied with Texas Rule of Appellate Procedure 10. The Court warned appellant that failure to file the brief and extension motion within the time allowed would result in the appeal being dismissed.

As of this date, appellant has not filed a brief or an extension motion nor has he otherwise communicated with this Court concerning this appeal. Under these circumstances, we DISMISS the appeal. See Tex.R.App.P. 38.8(a)(1); 42.3(b), (c).
