MAGISTRATE JUDGE WHITEHURST

JUDGMENT

This matter was referred to United States Magistrate Judge C. Michael Hill for Report and Recommendation. After an independent review of the record, and noting the absence of any objections, this Court concludes that the Report and Recommendation of the Magistrate Judge is correct and adopts the findings and conclusions therein as its own.

Accordingly, IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that Motion to Dismiss for Failure to State a Claim Pursuant to FRCP Rule 12(b)(6) filed by defendant, Timmy Hendrix d/b/a/ QUICKPICAUTO, on July 13, 2015 [rec. doc. 36], is GRANTED IN PART AND DENIED IN PART, and that the fraud claim under LA. CIV. CODE art. 1953 is DISMISSED WITH PREJUDICE.
