FRATERNAL BENEFICIARY ASSOCIATIONS, § 86suspension of member for nonpayment of dues. In action on benefit certificate, defended on ground that insured was not member in good standing at time of death by reason of suspension for nonpayment of dues, wherein it appeared that insured had been in arrears in paying dues to local lodge over a long period of time, but his dues had been regularly paid by local lodge to grand lodge up to month preceding insured's death, at which time he was purportedly suspended, held that, under the evidence, defendant grand lodge was estopped to assert suspension, no adequate notice thereof having been given insured.

Appeal from Circuit Court of Cook county; Hon. MICHAEL FEINBERG, presiding.

Affirmed. Heard in first division, first district, this court at April term, 1941.
