APPEAL AND ERROR, § 622confession of error. Where time for filing as part of record report of proceedings by appellee had expired, and motion therefor was denied, whereupon appellee, at suggestion of court, filed answer to appellant's objection to such motion, therein stating that if such report of proceedings were not before court latter would be compelled to find with appellant, such statement constituted confession of error on record, and rendered it unnecessary for appellate court to discuss errors relied upon for reversal in appellant's brief.

Appeal from the Municipal Court of Chicago; the Hon. GEORGE L. QUILICI, Judge, presiding.

Order reversed and cause remanded with directions. Heard in the second division, first district, this court at the October term, 1942.
