FORECLOSURE OF MORTGAGES, § 15when evidence failed to show that extension for payment of mortgage was granted. In action to foreclose lien of trust deed given to secure indebtedness evidenced by promissory note, where defendants, contended that indebtedness had not yet become due for reason that they were entitled to have time of payment extended, as set forth in letter from son of mortgagee to defendants, held that evidence showed that defendants did not ask that extension be given in conformity with such letter but submitted new proposition which was rejected.

Appeal from the Circuit Court of Cook county; the Hon. PHILIP J. FINNEGAN, Judge, presiding.

Decree affirmed. Heard in the first division, first district, this court at the February term, 1946.
