It is ordered that the opinion filed herein on April 8, 2008, and reported in the Official Reports (April 8, 2008, F050279 and F052448) ___Cal.App.4th ___[D.J.D.A.R. 5023]) be modified in the following particulars:
1. The second sentence of the last paragraph on page 2 and ending at the top of page 3 of our opinion in the above entitled case should be changed from:
The results of the trial were perhaps best described by Brawley’s counsel, Mr. Ley, who stated at a post-trial hearing “the jury socked it to both sides here.”

2. At the bottom of page 4 and continuing to the top of page 5, eliminate the entire paragraph beginning “Both of Brawley’s appeals are at first blush .…” and ending with “exceed the judgment he won ($19,800).”
This modification does not effect a change in the judgment.
