KEITH BOYNES, Appellant, v. THE STATE OF TEXAS, State.
Appeal from the 384th District Court of El Paso County, Texas (TC# 20180D04305)
Before Alley, C.J., Palafox and Soto, JJ.
ORDER
Pursuant to Texas Rule of Appellate Procedure 10.4 (a) the motion ruled on through this Order may have been decided by a single Justice sitting on the panel.
The Court grants the Court Reporter's fourth request for an extension of time to file the Reporter's Record until October 7, 2024. The reporter's record is now due to be filed on or before October 7, 2024, with the understanding, based on the court reporter's representations, that this is the FINAL extension of time needed to complete and file the record.
If reporter Kathleen Ann Supnet does not file the reporter's record by October 7, 2024, this Court will take further action to protect the parties' rights, which may include abating the cause and remanding to the trial court for a hearing to determine if another reporter should be assigned to complete the record in this cause, filing a report with the Judicial Branch Certification Commission, the regulatory agency overseeing Certified Court Reporters, issuing a show-cause order requiring Kathleen Ann Supnet to appear in person before this Court, or issuing an order of contempt finding Kathleen Ann Supnet in contempt for failing to file the reporter's record in a timely manner.
IT IS SO ORDERED.
