Gen. No. 41,228. (Abstract of Decision.)
Opinion filed December 23, 1940
TRUSTS, § 209 — managers selling property, evidence of fraud. In action by beneficiaries against trustee and trust managers of property under reorganization plan, charging fraud in negotiating sale of the property, complaint was properly dismissed, where allegations showed that two persons had made three different offers for the property, the lower bid being rejected when a higher one was received and the trustees trying to get the beat offer they could for the property, and plaintiff's allegation that higher offers had been made by other persons was too general and insufficient.
